When can a foreigner's residence permit in Slovakia be revoked

There is a common belief that after obtaining a residence permit, there is no need to worry about keeping it. However, in practice, the Foreign Police of Slovakia regularly checks compliance with the applicable conditions and, if violations are identified, may decide to cancel the residence permit.

The main reasons include:

• Lack of a genuine purpose of stay. If a residence permit was obtained, for example, for the purpose of conducting business, but the business activity is not actually carried out, this may constitute grounds for its cancellation.
• Insufficient or unverified income. When renewing a residence permit, it is necessary to prove financial means. If the income does not meet the minimum requirements or is absent altogether, this may signal to the police that the foreign national is unable to support themselves independently in the country.
• Use of false documents. Any forged or fictitious documents are considered a serious violation. In such cases, not only may the residence permit be cancelled, but deportation and a future entry ban may also be possible.
• Fictitious business activity. If an entrepreneur is formally registered as a self-employed person but actually works as an employee, especially for a single client, this may be regarded as an attempt to circumvent labour legislation.
• Actual absence from the country. A residence permit implies actual residence in Slovakia. If a person spends a long period of time outside the country, the authorities may conclude that the purpose of residence is not being fulfilled.
• Violation of the law. Administrative or criminal offences may result in the loss of the residence permit.

A decision to cancel a residence permit is not final — it can be appealed. Usually, an appeal must be filed within 15 days from the date of receipt of the notification. If this deadline is missed, the residence permit automatically becomes invalid.
