Who Is Considered a Family Member of an EU Citizen

The legislation of the European defines who may be recognized as a family member of an EU citizen and exercise the corresponding rights to residence, family reunification, and social guarantees.

Family members of an EU citizen include:
  • spouse;
  • children under 21 years of age, including minor and dependent children, as well as the children of the spouse;
  • dependent direct relatives in the ascending or descending line (for example, parents or children), as well as such relatives of the spouse;
  • dependent persons who do not fall into the categories listed above, if they are supported by the EU citizen in their country of origin;
  • other family members who live together with the EU citizen as part of the same household;
  • relatives who require personal care for serious medical reasons;
  • the partner of an EU citizen with whom the citizen has a durable and officially documented relationship.
Under this definition, family members of EU citizens may exercise the right to residence, employment, and social benefits in EU Member States on the basis of legislation on freedom of movement and family protection.
